1. Introduction

These Terms govern use of the Gas On Trade website and all products and services supplied by Gas On Trade. By visiting our website or purchasing our products you agree to these Terms. If you have a signed order or supply agreement, that document and these Terms apply together. If there is any conflict, the order or supply agreement takes priority.

2. Services

We supply food-grade and industrial gases, including but not limited to COâ‚‚ and related gas products, to commercial and private clients across the UAE. Specific product details, delivery arrangements, and pricing will be set out in your quotation, invoice, or supply contract.

3. Client Responsibilities

You must provide accurate and lawful order information, delivery details, and confirm compliance with all applicable UAE regulations for storage and use of gas products. You indemnify Gas On Trade against any claims arising from misuse or unlawful use of our products.

4. Third-party Assets and Licences

Where applicable we may source cylinders, valves, or related equipment from third-party manufacturers under their licences or warranties. Any such third-party terms will apply alongside these Terms. If you request products or equipment from non-approved suppliers you accept full responsibility for their compliance and safety.

5. Intellectual Property

All trademarks, branding, and marketing materials of Gas On Trade remain our property. Product-related technical documents supplied by us or third parties remain protected by respective owners’ intellectual property rights.

6. Pricing, Payment, and Invoicing

Quotes are valid for 30 days unless stated otherwise. Standard payment terms are as stated on the invoice. Payments are accepted via approved bank transfer or card processor. We do not store card details on our website. Late payments may incur charges permitted under UAE law. We may withhold delivery for overdue accounts.

7. Subscriptions and Regular Supply

Where regular scheduled deliveries or refills are agreed, the term and fees will be stated on your order or supply contract. We will provide notice of any price changes or renewal options.

8. Third-party Services and Logistics

Delivery may be carried out by trusted logistics partners. We are not liable for delays or failures caused by third-party carriers, port/customs delays, or government inspections outside our control.

9. Revisions and Order Changes

Confirmed orders cannot be altered without our written agreement. Changes after dispatch may incur restocking or additional delivery fees.

10. Confidentiality

Both parties agree to keep confidential business, pricing, and client information secure and use it only for the purpose of fulfilling orders. This obligation continues for five years after the last delivery or while the information remains confidential.

11. Data Protection

We comply with the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL) and relevant international standards. Our Privacy Policy and Cookies Policy explain how we process data. You must only provide personal or business data you are lawfully entitled to share.

12. Consumer Rights

Gas On Trade supplies both commercial and private clients. If you are a UAE consumer, your rights under UAE Consumer Protection Law apply. Due to the nature of gas products, returns are accepted only for faulty or damaged goods reported promptly on delivery. Custom-filled or used cylinders cannot be returned.

13. Product Warranties and Safety

We supply products that meet UAE quality and safety standards. Cylinders and valves are warranted against manufacturing defects as stated by us or the manufacturer. We are not liable for damage caused by incorrect storage, handling, or use contrary to guidelines and UAE safety regulations.

14. Limitation of Liability

Nothing limits liability for death, personal injury, or fraud. We are not liable for loss of profit, indirect losses, or damage arising from misuse or improper storage of gas products. Our liability is limited to the invoice value of the products supplied under the disputed order.

15. Termination

Either party may terminate an ongoing supply agreement for material breach if not remedied within 14 days. Either party may terminate rolling supply arrangements with 30 days’ written notice unless a fixed term is agreed. Upon termination you must pay for products delivered and any committed costs.

16. Force Majeure

Neither party is liable for delays or non-performance caused by events beyond reasonable control such as natural disasters, accidents, war, strikes, supply-chain disruptions, or government restrictions.

17. Non-solicitation

You agree not to directly solicit or hire our employees or contracted drivers/logistics personnel for six months after the last delivery without written consent. A recruitment fee may apply if breached.

18. Subcontractors

We may use vetted subcontractors or logistics partners to fulfil deliveries. We remain responsible for their performance under these Terms.

19. Compliance

Both parties must comply with all applicable UAE laws including health and safety regulations for pressurised gases, environmental regulations, anti-bribery, and anti-money-laundering laws.

20. Notices

Formal notices must be sent to our contact email above or to your nominated address, with a copy by email if applicable.

21. General

These Terms do not create any partnership or agency relationship. Assignment of rights requires prior consent except we may assign to an affiliated entity or acquirer. If any provision is invalid the remainder continues. No third party has rights under these Terms. Updates will be posted on our website and continued use or orders means acceptance.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates. The courts of the UAE shall have exclusive jurisdiction over any disputes.
